PARER II: SERVICE RULES
Time: 03 hrs. Max Marks : 100
Instructions to Examinees

Part A—One compulsory question of 20 marks.
Part B — Three (3) questions of which two (2) have to be attempted. 20 marks each for the two attempted answers.
Part C — Three (3) questions of which two (2) have to be attempted. 20 marks each for the two attempted answers.

PART-—A
Question (1)
From the data given below, calculate the following: (Total 20 Marks: 5 Marks for Each Part)

  1. Qualifying service
  2. Family Pension
  3. Death Gratuity
  4. Cash equivalent of leave salary.
    (a) Shri ‘X’, Date of birth 16.5.1968 and joined Government service on 1.7.1988 and while in service expired on 20.6.2018.
    (b) Leave not due for 40 days from |1.6.2000 on Medical certificate.
    (c) Extraordinary leave from 5.7.2011 to 15.8.2011, there is no mention in service book whether it will count for pension or not.

(d) The officer was under suspension from 15.2.2018 and he expired while under suspension on 20.6.2018. He was paid subsistence allowance as admissible.

(e)The officer has at his credit 258 days earned leave and 100 days half pay leave.

(f) The pay of the officer from 11.2016 was Rs.78,800/- in Level {2 in the pay matrix with DNI on 1.7.2016.

[As per 7 CPC pay matrix, Downward cells of Level-12 Pay matrix is 78,800, 81200, 83600, 86100, 88700, DA as on 1.1.2018- 7%|

(c) Encashment of Earned Leave for LTC while in service. (Marks 5)
(d) Leave Not Due and Commuted Leave (Marks 5)

(a) Special Leave connected to inquiry of Sexual Harassment (Marks 5)
(b) Define ‘Joining Time’ and also explain joining time in respect of “Transfer in case of same station & transfer from one station to another station’ in terms of CCS(Joining Time) Rules 1979 (Marks 5)
(c) Definition of ‘family’ in the context of GPF(Central Services) Rules, 1960 (Marks 5)
(d) ‘Superannuation Pension’ and ‘Retiring Pension’ (Marks 5)

(e) What are the general conditions for granting Children Education Allowances? Also describe special provision for Disable Children with reference to Children Education Allowance? (Marks 10)
(f) Explain the provisions of Enhancement, Reduction and Stoppage of subscription to the GPF? (Marks 10)

(a) What are the Minor and Major penalties to be imposed on Government Servant, as per the CCS (CCA) Rules, 1965? (Marks 10)
(b) Is article 226 of Constitution of India, a fundamental right? What is the difference between Article 32 and Article 226? Also explain the various writs issued by court to safeguard fundamental rights? (Marks 10)
